TERMS OF SERVICE (Pulsea)

These Terms of Service (“Terms”) govern your access to and use of the Pulsea mobile application and related services (collectively, the “Service”). The Service is provided by Pulsea Team (“Pulsea”, “we”, “us”, or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1) The Service
Pulsea - Share Your Fitness Journey
Pulsea helps users share and discover workout videos and engage with a fitness-focused community experience. Features may change over time, and some features may be available only in certain regions or on certain devices.


2) Eligibility and Account Registration
2.1 Age requirement
The Service is intended for users age 17 and older. By using the Service, you represent that you meet this requirement.

2.2 Account information
To use certain features, you may need an account. You agree to provide accurate and up-to-date information (such as name, username, and email address) and to keep it current.

2.3 Account security
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately at kironkiron667@outlook.com if you suspect unauthorized access.


3) Privacy
Your use of the Service is subject to our Privacy Policy. Please review the Privacy Policy for information on how we collect, use, and share data.


4) User Content and Community Conduct
4.1 User Content
The Service may allow you to create, upload, post, store, and share content (including videos, images, captions, comments, and other materials) (“User Content”).

You retain ownership of your User Content, but you grant Pulsea a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, distribute, publicly display, publicly perform, adapt, modify, and create derivative works of your User Content solely for the purposes of operating, developing, and providing the Service (including making User Content available to other users as you direct through your settings and actions).

4.2 Your responsibilities
You are responsible for your User Content and your use of the Service. You represent and warrant that:
- You have all rights necessary to post your User Content; and
- Your User Content and your use of the Service do not violate any laws or the rights of others.

4.3 Prohibited content and conduct
You agree not to do any of the following:
- Post unlawful, defamatory, harassing, hateful, or discriminatory content.
- Post pornographic content or sexual content involving minors, or any content that exploits or endangers children.
- Encourage dangerous activities or self-harm, or post content that presents a credible risk of physical harm.
- Impersonate others or misrepresent your affiliation.
- Infringe intellectual property rights, privacy rights, or publicity rights.
- Attempt to gain unauthorized access to the Service or interfere with its normal operation (including through malware, scraping, or automated abuse).
- Use the Service for spam, scams, or fraudulent activity.
- Reverse engineer or attempt to extract the source code of the Service, except to the extent permitted by law.

We may remove or restrict User Content and/or suspend or terminate accounts that violate these Terms.


5) Permissions and Device Features
Some features may require device permissions (for example, location, photos, camera, or notifications). You can control these permissions in your device settings. If you do not grant certain permissions, some features may not work.


6) Intellectual Property
The Service, including its software, design, text, graphics, logos, and other components, is owned by Pulsea Team or its licensors and is protected by intellectual property laws. You may not use our trademarks or branding without our prior written permission.


7) Third-Party Services and Links
The Service may contain links to third-party services or allow integrations. We do not control third-party services and are not responsible for their content, policies, or practices. Your interactions with third parties are between you and the third party.


8) Termination
8.1 Termination by you
You may stop using the Service at any time. You may also request account deletion by emailing kironkiron667@outlook.com from the email associated with your account.

8.2 Termination by us
We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms, pose a risk to the Service or other users, or if we must do so to comply with law.

8.3 Effect of termination
Upon termination, your right to use the Service ends. Certain sections of these Terms will survive termination, including Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.


9) Disclaimers
The Service is provided “AS IS” and “AS AVAILABLE”. To the maximum extent permitted by law, Pulsea Team disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Fitness content and user content are for informational purposes only and are not medical advice. You are responsible for your own health and safety. Consult a qualified professional before starting any fitness program.


10) Limitation of Liability
To the maximum extent permitted by law, Pulsea Team and its affiliates, officers, employees, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of (or inability to access or use) the Service;
- Any conduct or content of any third party on the Service; or
- Unauthorized access, use, or alteration of your content or information.

To the maximum extent permitted by law, Pulsea Team’s total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to Pulsea Team for use of the Service in the 12 months preceding the event giving rise to the claim (or, if you have not paid, 100 USD).


11) Indemnification
You agree to indemnify and hold harmless Pulsea Team and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Service;
- Your User Content; or
- Your violation of these Terms or any applicable law.


12) Dispute Resolution; Binding Arbitration
Please read this section carefully. It affects your rights.

12.1 Informal resolution first
Before filing a claim, you agree to contact us at kironkiron667@outlook.com and provide a brief description of the dispute and your contact information. We will try to resolve disputes informally within 30 days.

12.2 Binding arbitration
If we cannot resolve the dispute informally, you and Pulsea Team agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service through final and binding arbitration, rather than in court, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

The arbitration will be conducted in English, on an individual basis, by a reputable arbitration provider, and may be held remotely (for example, by video conference) where permitted by the arbitration rules.

12.3 Class action waiver
You and Pulsea Team agree that disputes will be resolved only on an individual basis, and not in a class, consolidated, or representative action.


13) Governing Law
These Terms are governed by the laws of the jurisdiction in which Pulsea Team has its principal place of business, without regard to conflict of law principles, except where such laws are superseded by mandatory consumer protection laws in your jurisdiction.


14) Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice within the Service or by other reasonable means. The “Effective Date” above indicates when these Terms take effect.
